Terms and Conditions of Sale
1. PURPOSE AND SCOPE OF THE TERMS AND CONDITIONS
SOPHIA DELLI is an entity of the company BEVERLUX, a limited liability company with a share capital of €45,735, registered with the Paris Trade and Companies Register under SIRET number 380 827 865, intra-community VAT number FR50 380 827 865, with its registered office located at 19 rue des Gravilliers, 75003 Paris.
These terms aim to define the conditions under which SOPHIA DELLI sells its bags and fashion accessories (hereinafter referred to as the “Product(s)”) through its website www.sophiadelli.com (the “Site”) to any natural person of legal age and legal capacity acting as a consumer (the “Customer”).
Any order placed on the Site is subject to these Terms and Conditions of Sale (“T&Cs”). These may be modified and updated, and the applicable terms are those in force on the date the order is placed.
2. ACCESS TO THE SITE AND CUSTOMER ACCOUNT
The Site is accessible to all internet users in principle 24 hours a day, 7 days a week, except in the event of interruption, scheduled or not, by SOPHIA DELLI or its service providers for maintenance, updates, or force majeure.
The option to create a customer account will be offered to the Customer during their first order on the Site. This account provides access to a personal space allowing better tracking and management of orders and personal information.
The information provided by the Customer must be complete, accurate, and up to date. The Customer agrees not to impersonate any third party or conceal or alter their age.
Account creation requires an email address and a confidential password. The Customer is responsible for keeping login credentials confidential and agrees not to disclose them under any circumstances. SOPHIA DELLI cannot be held responsible for loss of such information.
In case of suspected unauthorized use, the Customer must immediately notify SOPHIA DELLI to change the password or close the account.
3. PRODUCTS
Product photographs may slightly differ from reality due to screen settings and lighting. As handcrafted creations, items may show minor irregularities, variations in size, or color differences, which are not considered defects. SOPHIA DELLI cannot be held liable for such variations.
Essential characteristics are presented on product pages. However, photos, graphics, and descriptions are indicative only and not binding. Customers may contact SOPHIA DELLI at contact@sophiadelli.com for further information.
Products are offered subject to availability. Despite real-time updates, errors may occur. SOPHIA DELLI is not liable for stock shortages and may cancel an order, refunding any amounts paid.
4. ORDERS
The Customer must read the T&Cs before placing an order. Order validation constitutes acceptance.
The Customer must complete required fields or log in to an existing account.
SOPHIA DELLI cannot be held responsible for delivery failure due to incorrect information.
SOPHIA DELLI reserves the right to refuse an order in case of dispute or non-compliance.

The minimum order is €200 excluding VAT.
5. PRICES AND PAYMENT TERMS
The prices of the Products displayed on the Site are indicated in euros, including VAT, excluding customs duties and other taxes. These must be paid by the Customer directly to the carrier depending on the country of destination. Packaging, order processing and shipping costs are indicated before the order is confirmed.
SOPHIA DELLI reserves the right to modify the prices of its Products at any time and without prior notice, in particular due to changes in the economic, legislative and tax environment. Products are invoiced on the basis of the price in force at the time the Customer places the order.
The Products shall remain the full and exclusive property of SOPHIA DELLI until full payment of the corresponding order price has been received. Payment of the order by the Customer therefore constitutes finalization of the purchase contract.
After validation of the order, a confirmation message summarizing the order information (essential characteristics of the Products, price, payment method, right of withdrawal, delivery time and cost) will be sent to the Customer at the email address previously provided.
The Site offers payment by credit card (VISA, MasterCard). The Customer expressly acknowledges that providing their credit card number to SOPHIA DELLI constitutes authorization to debit their account up to the amount of the price of the Products ordered. Where applicable, a notification of order cancellation for non-payment will be sent to the Customer by email.
The data recorded and kept by SOPHIA DELLI shall constitute proof of the Order and of all transactions carried out.
6. PREPARATION AND DELIVERY OF THE ORDER
Orders are prepared by SOPHIA DELLI, located at 153 rue du Temple in the third arrondissement of Paris. SOPHIA DELLI undertakes to prepare and dispatch all orders placed before noon on the same day (business days).
The Products are delivered to the delivery address indicated by the Customer on the order form. It is the Customer’s responsibility to provide accurate and complete information
necessary for the proper delivery of the order (street number, building, staircase, access code, names and/or intercom numbers, etc.).
No delivery can be made to a hotel address or to a post office box.
The delivery time varies depending on the location and the delivery method chosen by the Customer:
- 24 to 72 hours via DPD France
- 24 to 48 hours via Chronopost;
- 2 to 5 business days via Colissimo within France;
- 5 to 10 business days via international Colissimo
- Choose payment method
- Proceed with payment of the order
An extension of preparation, dispatch and delivery times may occur during peak periods (holidays), in the event of social movements beyond SOPHIA DELLI’s control (strikes, demonstrations), or in the event of a change of delivery address by the Customer after the order has been registered.
In the event of an unreasonable delay in delivery, the Customer may request cancellation of the order under the conditions set out in Article L 216-2 of the French Consumer Code, namely by registered letter with acknowledgment of receipt sent to SOPHIA DELLI.
7. RECEIPT OF PRODUCTS
Upon receipt of their order, the Customer must immediately check the condition of the packaging of the parcel. If it is damaged, torn or opened, thereby causing damage to the Products contained therein, the Customer must refuse the parcel and note a reservation on the delivery slip (damage, missing item, damaged parcel, broken item, etc.). The signature of the delivery slip constitutes verification and acceptance of the parcel. Delivery shall be deemed to have been completed once the order has been made available to the Customer.
8. RETURNS AND REFUNDS
In accordance with the provisions of Articles L 221-18 et seq. of the French Consumer Code, the Customer may withdraw from their order at their sole discretion, without having to provide any reason, within a period of fourteen (14) days from the date of receipt of the Product.
The Customer may exercise their right of withdrawal by notifying SOPHIA DELLI. The request must be made clearly and unambiguously by email to contact@sophiadelli.com and must specify the order number and the Products concerned.
The return of a Product shall be at the Customer’s expense, unless the Product is non-compliant or has a manufacturing defect. In all cases, the Product must be returned to SOPHIA DELLI no later than fourteen (14) days following notification of the decision to withdraw.
SOPHIA DELLI undertakes to reimburse the Customer within a maximum period of fourteen (14) days after receipt of the returned Product or proof of shipment.
The refund will be made by bank transfer to the card used for the initial payment. Returned Products cannot be replaced or exchanged. A new order must be placed online. With regard to returns of personalized Products, Article L 121-20-2 of the French Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer’s specifications or clearly personalized.
SOPHIA DELLI shall therefore not be able to reimburse Products for which personalization has been requested.
9. WARRANTIES
LEGAL WARRANTIES
SOPHIA DELLI is required to deliver only Products that comply with the contractual provisions, that is to say Products which (i) conform to the description and possess the characteristics presented on the Site; (ii) are suitable for the purposes for which products of this kind are generally intended; (iii) meet the quality and durability standards generally expected of products of the same kind.
Failing this, the Customer benefits from the legal warranties against apparent defects on the one hand, and against lack of conformity and hidden defects on the other hand, under the conditions provided for by Articles L 217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.
The presence of an apparent defect on a Product must give rise to a claim by email to SOPHIA DELLI (sav@sophiadelli.com). Any claim must clearly specify the defect concerned; otherwise, the request shall be deemed inadmissible and the return impossible. The Customer will be required to return the defective Product to SOPHIA DELLI’s workshop under the following conditions:
- In its original packaging
- In its original condition
- New
- Unworn
- Unused
- Unmodified and undamaged
If the defect is confirmed, the Customer’s Product will be replaced or, if replacement is not possible, the Customer will receive a full refund of the price of the Product.
The existence of a lack of conformity allows the Customer to invoke the legal warranty of conformity. The Customer may thus:
- Benefit from a period of two (2) years from delivery of the Product to take action for lack of conformity;
- Choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L 217-9 of the French Consumer Code;
- Be exempt from providing proof of the existence of the lack of conformity for a period of six (6) months following delivery of the Product.
The legal warranty of conformity applies independently of any commercial warranty granted by SOPHIA DELLI. It also applies to hidden defects.
The legal warranty against hidden defects allows the Customer, within a period of two (2) years from discovery of the defect, to be protected against hidden defects in the purchased Product which render it unfit for use. In accordance with Article 1644 of the French Civil Code, the Customer then has two options:
- Keep the Product and request a reduction in its price;
- Return the Product and request a refund of the price paid.
The return conditions for a Product with hidden defects are the same as those stated above: it must be returned to the workshop in its original packaging and condition, and must not have been worn, used, modified or damaged.
10. CUSTOMER SERVICE
The Customer may contact SOPHIA DELLI’s customer service, or after-sales service (“Customer Service”), by email at sav@sophiadelli.fr or by completing the contact form available on the “Contact” page of the Site.
The Customer Service may be contacted by any Customer wishing to:
- Request information or ask questions;
- Track an order;
- Invoke a warranty;
11. INTELLECTUAL PROPERTY
The Customer acknowledges that SOPHIA DELLI’s Products and distinctive signs (trademarks, logos, company names, acronyms, images, photographs and the composition of photographs, concepts, packaging, product names, texts, illustrations, etc.) are the exclusive property of SOPHIA DELLI under intellectual property law, for the entire duration of protection of these rights and worldwide.
The Customer shall refrain from any act of reproduction or use of Product models, packaging, photographs, compositions of photographs, concepts, product names, texts, illustrations, trademarks or distinctive signs, trade secrets, techniques or know-how used by SOPHIA DELLI, as well as any act aimed at appropriating these elements.
Consequently, any reproduction not authorized by SOPHIA DELLI shall constitute an infringement and may give rise to legal proceedings.
12. PROCESSING AND PROTECTION OF PERSONAL DATA
SOPHIA DELLI considers the security of the processing of its Customers’ personal data via its Site to be a priority and undertakes to ensure compliance of its data processing activities in accordance with the applicable provisions of Law No. 2018-493 of June 20, 2018 relating to the protection of personal data.

13. DISPUTE RESOLUTION
In the event of a dispute, the Customer must first contact SOPHIA DELLI’s after-sales service by email at sav@sophiadelli.com.
If no solution is found within 21 days, the Customer may refer the matter to the Joint Mediation Commission for Direct Selling, located at 100 avenue du Président Kennedy, 75016 Paris (+33 1 42 15 30 00, info@cmpvd.fr, http://mediation-vente-directe.fr/).
This Commission will seek an amicable resolution free of charge.
14. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by French law and subject to the jurisdiction of the courts of Paris.
Failing an amicable agreement, all disputes relating to these Terms shall be submitted to the competent courts in accordance with applicable law.
